These Terms of Service should be read alongside, and in addition to the Privacy Policy.

Definitions

  • User: means you, or another person named by you who is authorized to incur charge/change to your Account.
  • Buyer: means the person, or company who agrees to buy or buys Gotek Smart Watch from Gotek Telecom LTD.
  • Website: means your engagement on the Gotek Telecom Websites, including, https://gotektelecom.com / https://gotekiot.com / https://gotekcloud.com
  • Gotek IoT: is a brand owned and operated by Gotek Telecom LTD. Gotek IoT develops and produces the hardware products of Gotek Telecom LTD. https://gotekiot.com
  • Gotek Cloud: is a brand owned and operated by Gotek Telecom LTD. Gotek Cloud is a cloud service accessible by the user to operate Gotek IoT hardware. This includes the usage of Mobile App products of different services. https://gotekcloud.com
  • Gotek Smart Watch: is a 4G Healthcare enabled Smart Watch, used to measure health vitals, location tracking, GSM two-way calling, SOS emergency button, receive pre-set notifications and alarms.
  • IMEI: (International Mobile Equipment Identity) a unique serial number used to identify your Gotek Smart Watch.
  • Gotek Smart Watch Data: Data packages sent from Gotek Smart Watch to Gotek Telecom LTD servers that include Health Vitals Data, GPS Tracking Data, and other data packages used to control/monitor and represent the data on Gotek Cloud web login and Gotek Smart Watch Mobile App.

General

Gotek Smart Watch is one of Gotek IoT family of products that is controlled and operated from Gotek Cloud. Gotek Smart Watch motivates and encourages the user for a better health and life style by monitoring the health parameters to give a better insight and understanding of the users’ health status. Gotek Smart Watch is NOT to be used for accurate medical diagnosis, always refer to professional medical help and consult your doctor.Your purchase of Gotek Smart Watch and/or registration and/or usage of Gotek Cloud web login and Gotek Smart Watch Mobile App, are governed by these terms and conditions. By using/registering Gotek Smart Watch and its services makes you legally bound and agree to these terms and conditions.

 

These terms and conditions may be amended by Gotek Telecom LTD at any time. Where such amendments are made Gotek Telecom LTD will provide the amended terms and conditions on the website. If there is any inconsistency between these Terms and Conditions and the details of any request and/or order made by you for the purchase of Gotek Smart Watch Products and/or Services then these terms and conditions will prevail to the extent of such inconsistency.

 

The user or the user’s representative must be 18 years of age or older to order Gotek Smart Watch through the Website. By placing an Order, the user or the user’s representative acknowledges that he or she is 18 years of age or older.

 

Different models and versions of Gotek Smart Swatch may emerge or alter due to obsoletion / upgrades / upcoming new models. Use of Gotek Smart Swatch services includes its associated hardware, mobile application, web platform cloud service, websites, and APIs. Gotek Telecom LTD has the right to change, update, upgrade features as it sees fit without prior notice to the user.

Activation

User must accept these terms and conditions in order to create or use Gotek IoT and Gotek Cloud account for its products and services. If you do not accept these terms and conditions, you may use Gotek Smart Watch offline without the use of its online services including Gotek Smart Watch mobile application, web platform cloud service, and website. In order to use Gotek Cloud and Gotek Smart Watch mobile app online services you must own and purchase Gotek IoT products.

 

To register your Gotek Smart Watch and use Gotek Cloud online services, you need to enter your device’s IMEI number during registration. The IMEI number can be obtained from gift box (package) you received when you purchased Gotek Smart Watch / from the settings menu in the watch / QR Code in the settings menu of the watch / while charging the watch the number will show (depending on Gotek Smart Watch Version obtained).

 

User holds full responsibility of purchasing and providing a 4G internet enabled and activated SIM Card from your local operator to be inserted in Gotek Smart Watch for it to function. Gotek Telecom LTD is not held responsible for your local country’s communication and telecommunication laws, you should be aware of your country’s laws and regulations. Some countries may block the IMEI of Gotek Smart Watch (the same is applied to other devices such as smart phones and tablets, etc.), thus resulting the watch not to connect to Gotek Telecom LTD servers in which Gotek Cloud and Gotek Smart Watch Mobile App will not function or show any type of Gotek Smart Watch Data.

 

If Buyer purchased any previous version of Gotek Smart Watch such as, Gotek Smart Watch Version 2.2 – 2G version, then Buyer holds full responsibility to purchase and provide a 2G internet enabled SIM Card from his local operator. Failing to provide a 2G internet enabled SIM Card will result Gotek Smart Watch not to connect to Gotek Telecom LTD servers in which Gotek Cloud and Gotek Smart Watch Mobile App will not function or show any type of Gotek Smart Watch Data.

Usage

User holds full responsibility for all activity and use/misuse of your account, including the distribution and sharing of your account credentials. You may pass and share your credentials to your doctor/care giver/family member under your full responsibility; Gotek Telecom LTD doesn’t hold the responsibility of any misuse or data changes that occur in the user account by the user.

Support

If User is facing any issues regarding the account on Gotek Cloud web login or Gotek Smart Watch Mobile App, you may communicate with the support to solve the issue soonest possible through the appropriate support channels on the Gotek Cloud website (https://gotekcloud.com/support) or stated otherwise on the website. To provide appropriate support you should consent to providing appropriate information and data about your usage and interaction with Gotek Smart Watch Mobile App and Gotek Cloud web login, this may include providing the IMEI number of your Gotek Smart Watch, name, email, phone number, etc. Please refer to the Privacy Policy for more information.

Warranty

If the Buyer believes Gotek Smart Watch to be faulty upon delivery (within 5 working days of delivery) then the Buyer should immediately send an email to support@gotekcloud.com and provide the IMEI number of the device with proof and explanation of the believed fault in Gotek Smart Watch (pictures or videos). Buyer should provide appropriate invoice number and their relevant contact details together with full details of the fault affecting the Product. The Buyer shall then immediately return (after approval from Gotek Telecom LTD) any such faulty Products directly to the address advised by the communication and emails provided from support@gotekcloud.com . Gotek Telecom LTD shall assess any faulty Products and shall use all reasonable endeavors to repair the Product; If it is not possible to repair Gotek Smart Watch and provide the support to do so during email communication, then Gotek Telecom LTD shall offer the Buyer a replacement or a full refund at the Buyer’s option; If any of these options are chosen then the Buyer agrees to send Gotek Smart Watch back to Gotek Telecom LTD and once received then the refund or the replacement shall be sent back to the Buyer.

 

It is the Buyer’s responsibility to return Gotek Smart Watch to Gotek Telecom LTD at the Buyer’s own cost and risk. Until Gotek Smart Watch is received back by Gotek Telecom LTD the Buyer shall remain liable for Gotek Smart Watch and shall indemnify Gotek Telecom LTD in respect of any loss or damages suffered by Gotek Smart Watch as a result of the Buyer’s failure to return the Gotek Smart Watch in an ‘as received’ and ‘as described’ condition that has been made clear in the email communication.

Termination of Account

User account will not be deleted by Gotek Telecom LTD, unless it has not been active for more than a year then Gotek Telecom LTD has the right to terminate the account which will result in full deletion of the account, thus losing all your Gotek Smart Watch Data.

 

User has the full right to delete the account and all Gotek Smart Watch Data associated with that account. To do so, user has to send an email to support@gotekcloud.com or the support link (https://gotekcloud.com/support/) to submit the request and consent to do so.

Miscellaneous

These terms and conditions are subject to change at any time without prior notice. Gotek Telecom LTD reserves the right to modify, add and delete any of the services provided through any features from those that are available at the time of purchase.

 

The Buyer/User is solely responsible for the content of information and communications transmitted using Gotek Smart Watch and its services through Gotek Cloud web login or Gotek Mobile App. Gotek Telecom LTD will not be liable nor accept any liability for incorrect use of any Product.

 

Gotek Telecom LTD may modify or suspend the online services (Gotek Cloud web login and Gotek Smart Watch Mobile App), wholly or partially, without notice where such modification or suspension is deemed necessary by us (e.g., for maintenance, upgrading, security, emergency or other valid reasons) or by an authorized authority. All reasonable efforts shall be made to minimize such Service disruptions; however, some interruption may be inevitable. We will notify you were and as soon as it is practicable to do so.

Notification of Changes

This version of the Agreement takes effect from 1st Of March. 2022 and shall remain valid and active until amended or terminated in accordance with the relevant provisions of the Agreement. Please refer to this link for any future amendments.
